1. Agreement to Terms
By accessing our website at fsltraining.com, using the FSL Training app, booking a consultation, or enrolling in any FSL Training program or service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
These Terms and Conditions apply to all visitors, clients, and users of FSL Training services, including but not limited to personal training, nutrition coaching, wellness coaching, online coaching, corporate wellness programs, and the FSL Training app.
2. Services
FSL Training provides the following services:

Private 1-on-1 personal training (in-person, Manhattan)

Online and remote coaching via the FSL Training app

Nutrition coaching and meal planning

Wellness coaching and stress management support

The Wellness 360 Program
-
The 28-Day Jumpstart Program

Corporate wellness programs via the WellLife Employee Wellness Series
FSL Training reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected clients. We also reserve the right to refuse service to anyone at our discretion.
3. Health and Medical Disclaimer
Please read this section carefully.
FSL Training provides fitness, nutrition, and wellness coaching services. We are not a medical organization and our coaches, trainers, and staff are not licensed physicians, physical therapists, registered dietitians, or mental health professionals unless otherwise specifically stated.
By engaging with FSL Training services you acknowledge and agree that:

You have consulted with a licensed physician or qualified healthcare provider before beginning any fitness or nutrition program, or you assume full responsibility for doing so

FSL Training services are not a substitute for professional medical advice, diagnosis, or treatment

You will immediately inform your FSL Training coach of any changes to your health, medical conditions, injuries, or medications that may affect your ability to participate in training

FSL Training is not liable for any injury, illness, or adverse health outcome that may occur during or as a result of participation in our programs
If you experience chest pain, shortness of breath, dizziness, or any other medical emergency during a training session, stop immediately and seek emergency medical attention.
4. Client Responsibilities
As an FSL Training client you agree to:

Provide accurate, complete, and current information about your health history, medical conditions, injuries, and fitness level during the intake and assessment process

Update your coach promptly if any health information changes during your program

Follow the guidance, safety instructions, and recommendations provided by your FSL Training coach

Arrive on time for scheduled sessions and provide adequate notice for cancellations

Treat all FSL Training staff, coaches, and fellow clients with respect

Use the FSL Training app and any provided materials solely for personal, non-commercial purposes

Not share your FSL Training app login credentials with any other individual
5. Booking, Cancellations, and Rescheduling
Bookings All sessions and consultations must be booked in advance through the FSL Training booking system. Bookings are confirmed upon receipt of payment or signed agreement where applicable.

Cancellations We require a minimum of 24 hours notice to cancel or reschedule a session. Cancellations made with less than 24 hours notice may result in forfeiture of that session without refund at FSL Training's discretion.

No-Shows Clients who fail to attend a scheduled session without prior notice will forfeit that session. Repeated no-shows may result in termination of the client agreement.

Late Arrivals If you arrive late to a session, the session will end at the originally scheduled time and will not be extended. The full session fee applies regardless of arrival time.

FSL Training Cancellations In the event FSL Training must cancel a session, we will provide as much advance notice as possible and will reschedule the session at no additional charge to you.
6. Payment Terms
Fees Program and session fees are communicated at the time of enrollment. FSL Training reserves the right to adjust pricing with reasonable advance notice to existing clients.

Payment Payment is due at the time of booking or enrollment unless a payment plan has been agreed upon in writing. We accept all major credit cards and other payment methods as communicated at the time of purchase.

Late Payments Accounts with outstanding balances may result in suspension of services until payment is received. FSL Training reserves the right to charge late fees on overdue accounts.

Chargebacks If you initiate a chargeback or payment dispute without first contacting FSL Training to resolve the matter, we reserve the right to suspend or terminate your access to services and pursue collection of outstanding amounts.
7. Refund Policy
Consultations Free consultations are non-refundable as they carry no charge.

Programs and Packages Refunds for program packages are considered on a case-by-case basis. Requests for refunds must be submitted in writing to info@fsltraining.com within 7 days of purchase. No refunds will be issued after services have been substantially delivered or after the 7-day window has passed.

28-Day Jumpstart Program Due to the digital nature and immediate access provided upon enrollment, the 28-Day Jumpstart Program is non-refundable once access has been granted.
​
Corporate Wellness Programs Refund terms for corporate wellness engagements are governed by the individual service agreement executed between FSL Training and the contracting organization.
8. Intellectual Property
All content on the FSL Training website, FSL Training app, and in our programs — including but not limited to workout programs, meal plans, coaching materials, written content, videos, graphics, logos, and the FSL Training brand — is the exclusive intellectual property of FSL Training and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any FSL Training content without our prior written consent. Unauthorized use of FSL Training intellectual property may result in legal action.
9. Testimonials and Client Content
By providing a testimonial, review, before-and-after photo, or success story to FSL Training, you grant us a non-exclusive, royalty-free, perpetual license to use that content for marketing and promotional purposes across our website, social media, and other materials. We will always seek your explicit permission before using identifiable photos or personal details. You may withdraw consent at any time by contacting us at info@fsltraining.com.
10. Limitation of Liability
To the fullest extent permitted by applicable law, FSL Training, its owner, coaches, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages; including but not limited to personal injury, property damage, lost profits, or data loss arising out of or related to your use of our services, website, or app.

FSL Training's total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount paid by you to FSL Training in the three months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless FSL Training, its owner, coaches, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights.
12. Assumption of Risk
Physical exercise involves inherent risks including but not limited to muscle soreness, injury, and in rare cases serious physical harm. By participating in FSL Training programs you voluntarily assume all risks associated with physical exercise and fitness activity, whether conducted in person or remotely. You acknowledge that you are physically capable of participating in the program you have enrolled in and that you have disclosed all relevant health information to your coach.
13. Privacy
Your use of FSL Training services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at fsltraining.com/privacy-policy.
14. Third-Party Services and Links
FSL Training uses third-party platforms to deliver its services, including for booking and CRM, the FSL Training app platform for remote coaching, and payment processors for billing. Your use of these platforms is subject to their respective terms of service and privacy policies. FSL Training is not responsible for the practices or content of any third-party service.
Our website may also contain links to third-party websites including FSL Foundation (fitnesssaveslives.org). These links are provided for your convenience and do not constitute an endorsement. FSL Training is not responsible for the content or privacy practices of linked sites.
15. Termination
FSL Training reserves the right to terminate or suspend your access to our services at any time, with or without cause, and with or without notice, including but not limited to violations of these Terms, non-payment, or conduct that FSL Training determines to be harmful to other clients, staff, or the business. Upon termination, your right to use our services ceases immediately.

You may terminate your engagement with FSL Training at any time by providing written notice to info@fsltraining.com, subject to any outstanding payment obligations or program commitments.
